US District Court Judge Jeb Boasberg appears to have broken federal law to help with Jack Smith’s witch hunt against President Donald Trump and MAGA. Boasberg allegedly ignored an important separation of powers law by allowing Smith to spy on Sen. Ted Cruz (R-TX), according to new documents brought forward by FBI whistleblowers this week. It was also revealed that Jack Smith’s dragnet against MAGA was much larger than Congress previously thought. This scandal has now ballooned into something much larger and much more sinister than Watergate.
FBI whistleblowers turned over a new tranche of documents to Sen. Chuck Grassley (R-IA). During an earlier October disclosure, we learned that Jack Smith had spied on and subpoenaed the phone records of more than 100 leaders of MAGA-related organizations. This new disclosure reveals that Smith’s team spied on about 430 people, including Sen. Ted Cruz.
That’s cute. At least they’re getting warmer on the real number.
There were at least 1,000 people affiliated with President Trump who were caught up in Arctic Frost. After checking through the 1,700 new pages that Grassley just released, I still haven’t seen my name come up. So, there is still a lot more disclosure that needs to happen.
The fact that Jack Smith dragged Ted Cruz into the Arctic Frost probe is new and shocking information, though. We knew from the earlier disclosure that 10 other GOP Senators had been spied on.
Smith subpoenaed Sen. Cruz’s phone records for early January 2021. Smith wanted to see whether there was any evidence that could be used to frame Cruz for trying to “overthrow the government” on January 6 fake insurrection that involved nearly 400 FBI and other federal agents storming the Capitol.
Judge Boasberg not only granted Smith the warrant to subpoena Cruz’s phone records, but also issued a gag order against AT&T. He ordered AT&T not to notify Sen. Cruz that his phone records had been subpoenaed, including his cell phone and his office land line. That is a clear violation of federal law, and Boasberg has to know that.
2 USC 6628 bans gag orders on the collection of Senate data and communications. This is an important checks and balances issue. The Department of Justice is under the Executive branch. The law requires that Senators be informed that their communications are being subpoenaed. This gives the Senate (not Ted Cruz personally, but the Senate as a body) the chance to quash a subpoena under separation of powers.
Without that law in place, any president could weaponize the Justice Department to go after the opposition party. Which is exactly what happened with Joe Biden in office, thanks to Boasberg.
Boasberg’s legal and ethical lapses were worse than that, however. Without any evidence, Boasberg put the gag order on AT&T, insisting that Ted Cruz would destroy and tamper with evidence and witnesses if he was informed about the subpoena.
Notice that once again, the FBI did not turn over these documents to Sen. Grassley’s committee as requested. Whistleblowers are the only reason we have this new information. FBI agents who violated the civil liberties of MAGA patriots are still working there. They haven’t faced any consequences.
Unless people go to prison for Arctic Frost, life in America is going to turn into hell on earth the next time a Democrat is in power. Think of every Democrat that you know personally. Do any of them think the Justice Department’s lawfare against President Trump and his allies went too far?
None of them do. They all think the DOJ and Jack Smith didn’t go far enough!
The FBI agents and DOJ lawyers who participated in Arctic Frost all need to go to prison for what they did. If this doesn’t happen, the next time a Democrat is in power will be so much worse. There will be gulags and death camps for Republicans. Bill Clinton’s former advisor, James Carville, is already threatening this.
Ted Cruz is calling for the House to immediately impeach Judge Boasberg. Now you’re talkin’!
I am, right now, calling on the House of Representatives to impeach Judge Boasberg.
Mark my words: there will be accountability for these partisan zealots who sought to corrupt the DOJ and judiciary to attack their enemies. pic.twitter.com/J8lkD1fvmL

That would be a good first step. Boasberg appears to have committed a clear violation of 2 USC 6628. He should be impeached. And don’t bother trying to tell us that “the votes aren’t there in the Senate.”
Since when do Democrats ever worry about that? They already have Articles of Impeachment drawn up against President Trump, in hopes that they carry the House in next year’s midterms. Republicans in Congress need to start fighting back in earnest, or they’re going to end up in a cell right next to the rest of us.
