CNN's top legal analyst Elie Honig had one job on October 14: explain the federal investigation into Rep. Ilhan Omar (D-MN) without helping her. He did it in one sentence. The investigation, Honig told anchor Jake Tapper, was "started under" the Biden administration — and that fact, he said, is "gonna undermine any argument she has that it's politically selective and vindictive."
That wasn't Fox News. That wasn't Newsmax. That was CNN's own legal expert, on CNN's own air, dismantling the one defense Omar had left.
Here's what Omar is facing. Two separate federal probes — one run by Homeland Security Investigations examining immigration fraud, the other a financial crimes investigation announced by D.C. U.S. Attorney Jeanine Pirro on October 13. HSI agents searched Omar's Washington residence on October 12, removing her cellphone, computer, passport, and notebooks. Grand jury subpoenas have been served on at least 12 family members. Her husband Tim Mynett told reporters his wife "came here when she was 12 years old as a child war refugee" and that he had "no concerns."
The immigration probe centers on whether Omar's family misrepresented her age when she entered the United States in 1995. She became a naturalized citizen in 2000, listed as 17 years old — an age that made her eligible for automatic citizenship through her father's naturalization. Investigators are now examining a birth year discrepancy: congressional staff reportedly requested a Minnesota library change her birth year in records from 1981 to 1982. The possible charges include conspiracy and making false statements in immigration paperwork.
Omar has called the investigation an attempt at "being silenced" and denied wrongdoing. Her Democratic colleagues have lined up behind the same script — Trump is weaponizing the DOJ, this is political persecution, the timing is suspicious.
Then CNN aired Honig's analysis and the script stopped working. Even Jake Tapper leaned in with what might be the most devastating question a friendly anchor has ever asked about a Democratic member of Congress: "Would it not have been wiser for the congresswoman to have gone to the Biden Justice Department and said this has happened and there was a mistake and I'd like to come clean?"
That question contains its own answer. If Omar's citizenship paperwork was legitimate, there was nothing to "come clean" about. If it wasn't, she had four years of a sympathetic DOJ to sort it out quietly — and she didn't.
The Biden-era probe, according to CNN's own reporting, focused on Omar's finances, campaign spending, and interactions with foreign citizens. It stalled. But it existed. Federal prosecutors opened that financial inquiry as early as June 2024. The Trump administration didn't invent an investigation — it picked up one that Biden's DOJ started and let collect dust.
Some major networks didn't even cover the story on Monday night. But a Democrat-appointed judge, Matthew Sharbaugh of the D.C. District Court, signed the search warrant. Biden's prosecutors opened the case. CNN's own analyst said it undermines the persecution claim.
When your warrant comes from a Democratic judge, your investigation was launched by a Democratic DOJ, and your defense gets dismantled on the network your party treats as home court — the "political vendetta" argument isn't just weak.
It's already been answered.
